INTRODUCTION
Christian Appalachian Project (“CAP,” “we,” “our,” or “us”) welcomes you to our website, donation platforms, and related online services (collectively, the “Services”). These Statement of Terms and Services (“Terms”) govern your access to and use of the Services provided by CAP.
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any applicable laws and regulations. If you do not agree with these Terms, you should not access or use the Services.
These Terms apply solely to online interactions and services provided through CAP’s digital platforms and do not govern offline activities unless expressly stated.
CAP reserves the right to update or modify these Terms at any time. For material changes, CAP will provide reasonable notice by updating the “Last Updated” date. Changes become effective upon posting to the Services. Your continued use of the Services following any changes constitutes acceptance of the revised Terms.

ELIGIBILITY
By using the Services, you represent and warrant that:
- You are at least eighteen (18) years of age, or are using the Services under the supervision of a parent or legal guardian;
- You possess the legal authority to enter into these Terms;
- Any information you provide to CAP is accurate, current, and complete.
CAP reserves the right to refuse access to the Services to any person or entity at any time for any lawful reason.
USE OF SERVICES
CAP grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for lawful, personal, informational, charitable, and non-commercial purposes.
You agree not to:
- Use the Services for unlawful or fraudulent purposes;
- Attempt to gain unauthorized access to any portion of the Services or related systems;
- Interfere with or disrupt the operation or security of the Services;
- Upload or transmit malicious code, viruses, or harmful technologies;
- Use automated systems to scrape, harvest, or collect information from the Services;
- Misrepresent your identity or affiliation with any person or organization;
- Use the Services in any way that could damage CAP’s reputation, operations, or mission.
CAP reserves the right to investigate and take appropriate legal action regarding violations of these Terms.
By using the Services, you consent to receive communications from CAP electronically, including emails and website notices.
DONATIONS AND PAYMENT TERMS
CAP accepts donations through secure third-party payment processors and fundraising platforms. By making a donation through the Services, you agree that:
- All donation information provided is accurate and authorized;
- You are legally authorized to use the selected payment method;
- Donations are voluntary and generally non-refundable unless required by law or approved by CAP;
- Recurring donations will continue according to the schedule selected until modified or canceled by you.
- Donations may be tax-deductible to the extent permitted by law. Donors are responsible for consulting their tax advisors.
CAP uses commercially reasonable security measures to protect payment transactions. However, no internet transmission or electronic storage system can be guaranteed completely secure.
CAP may use trusted third-party vendors and processors to facilitate donation transactions, recurring billing, donor management, and related services.
CAP will make reasonable efforts to honor donor intent, if any, but reserves the right to use donations where most needed consistent with its mission.
VOLUNTEER AND EVENT PARTICIPATION
Certain Services may permit users to register for volunteer opportunities, fundraising events, mission activities, or community programs.
By participating in CAP-sponsored activities, you acknowledge and agree that:
- Participation may involve inherent risks;
- You are voluntarily participating and assume personal responsibility for your actions;
- CAP may require additional waivers, releases, or agreements before participation;
- CAP reserves the right to deny or revoke participation at its discretion.
You further agree to conduct yourself respectfully and lawfully during all CAP-related activities.
INTELLECTUAL PROPERTY RIGHTS
All content, materials, graphics, logos, designs, text, software, images, videos, audio recordings, and other elements made available through the Services (“Content”) are owned by or licensed to CAP and are protected by applicable copyright, trademark, and other intellectual property laws.
Except as expressly permitted in writing by CAP, you may not:
- Reproduce, distribute, modify, display, publish, or transmit Content;
- Use CAP trademarks, branding, or logos in any manner not expressly authorized in these Terms;
- Create derivative works based on the Services or Content;
- Commercially exploit any aspect of the Services.
Limited sharing of CAP Content for personal, educational, ministry, or charitable purposes is permitted provided proper attribution is maintained and the content is not altered in any material or misleading manner.
You further agree that Content provided through the Services is for informational and ministry purposes only and does not constitute legal, medical, financial, or professional advice.
USER-GENERATED CONTENT
The Services may permit users to submit communications, prayer requests, comments, testimonials, photographs, videos, or other materials (“User Content”).
By submitting User Content, you grant CAP a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, distribute, display, and create derivative works from such content in connection with CAP’s mission, operations, communications, and promotional activities.
You represent and warrant that:
- You own or control the rights to the User Content;
- The User Content does not infringe the rights of any third party;
- The User Content is not unlawful, defamatory, abusive, obscene, or misleading.
CAP reserves the right, but not the obligation, to review, remove, or refuse User Content at its sole discretion.

CAP is committed to safeguarding donor and participant information and implementing commercially reasonable security practices to protect personal data.
THIRD-PARTY SERVICES AND LINKS
The Services may contain links to third-party websites, applications, social media platforms, or services that are not owned or controlled by CAP.
CAP does not endorse and is not responsible for:
- The content or practices of third-party sites;
- The availability or functionality of third-party services;
- Any transactions conducted through external platforms.
Users access third-party websites and services at their own risk and should review the applicable terms and privacy policies of those providers.
ARTIFICIAL INTELLIGENCE AND TECHNOLOGY USE
CAP may utilize technology tools, including Artificial Intelligence (“AI”), to support communications, operational efficiency, accessibility, and content development.
All AI-assisted content is subject to human oversight and review to ensure alignment with CAP’s mission, values, and standards but may contain inaccuracies. Users should not rely solely on AI-assisted content. CAP does not use AI to replace human judgment in ministry or service delivery.

DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, CAP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT;
- UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SERVICES.
CAP DOES NOT GUARANTEE THAT THE SERVICES WILL BE FREE OF VIRUSES, HARMFUL CODE, OR SECURITY BREACHES.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAP, ITS AFFILIATES, EMPLOYEES, VOLUNTEERS, DIRECTORS, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:
- USE OF OR INABILITY TO USE THE SERVICES;
- DONATION TRANSACTIONS;
- USER CONTENT;
- UNAUTHORIZED ACCESS TO DATA;
- THIRD-PARTY CONDUCT OR SERVICES;
- INTERRUPTION OR LOSS OF DATA.
IN NO EVENT SHALL CAP’S TOTAL LIABILITY EXCEED THE AMOUNT PAID, IF ANY, BY YOU TO CAP THROUGH THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless CAP and its affiliates, directors, officers, employees, volunteers, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses arising from:
- Your violation of these Terms;
- Your misuse of the Services;
- Your infringement of any third-party rights;
- Any User Content submitted by you.
TERMINATION
CAP reserves the right, in its sole discretion and without prior notice, to suspend or terminate your access to the Services for any reason, including violation of these Terms.
Termination does not limit CAP’s rights or remedies available under law.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located within Kentucky, and users consent to the jurisdiction of such courts.
At CAP’s discretion, disputes may be resolved through binding arbitration rather than court proceedings, except where prohibited by law.
ACCESSIBILITY
CAP strives to make the Services accessible to all individuals, including those with disabilities. We are committed to improving accessibility and usability consistent with applicable standards and best practices.
